Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Unleashed Systems LLC ("Company," "we," "us," or "our") concerning your access to and use of The Method mobile application and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Description of Service

The Method is a language learning application that provides audio-based learning experiences to help users learn new languages. The Service includes phrase learning, listening exercises, progress tracking, and related educational features. The Service is for educational purposes only and does not constitute professional, academic, or certified instruction.

User Accounts

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account and use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Copy, modify, or distribute our content without permission

Intellectual Property

The Service and its original content, features, and functionality are owned by Unleashed Systems LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

Any learning progress, preferences, and other data you generate through your use of the Service ("User Content") remains associated with your account. We do not claim ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display such User Content solely as necessary to operate, maintain, and improve the Service.

Communications

By creating an account and providing your email address, you consent to receive electronic communications from us, including:

• Account-related notices (verification, security alerts, important updates to the Service)
• Information about new features, product improvements, and tips for using The Method

You may opt out of non-essential communications at any time by using the unsubscribe link in any email or by contacting us. Opting out of marketing communications will not affect transactional messages necessary for the operation of your account.

Third-Party Services

The Service may contain links to or integrations with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee any specific learning outcomes from using the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLEASHED SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Account Termination

You may delete your account at any time through the app settings. Upon deletion, your account and associated data will be removed from our active systems. Some information may persist in backups for a limited period of time as described in our Privacy Policy.

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or third parties.

Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its rules. The arbitration will be conducted on an individual basis, and not in a class, consolidated, or representative action.

Either party may bring a claim in small claims court if it qualifies. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent or stop unauthorized use or abuse of the Service or infringement of intellectual property rights.

The arbitration shall take place in Delaware unless the parties agree otherwise.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. We may also provide notice through the app or by email. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Assignment

We may assign or transfer these Terms, and any rights and licenses granted hereunder, without restriction. You may not assign or transfer these Terms without our prior written consent.

Eligibility

By using the Service, you represent that you are legally permitted to use the Service in your jurisdiction and that your use complies with all applicable laws and regulations.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Unleashed Systems LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral.
